Adamopoulos, Divorce Mediator, Arbitrator and Collaborative Divorce Attorney<\/i><\/span><\/p>\n<p>Alimony here refers to the most common type \u2013 General Term.<\/p>\n<p>The length or duration of alimony is contingent on two factors.<\/p>\n<p><u>The first<\/u> is the <em>length<\/em> of the marriage. (Italics are quotes from the Alimony Reform Law.)<\/p>\n<p>The <em>length of the marriage <\/em>begins, at a minimum, from the date of marriage. However, <em>the court <\/em>(or arbitrator)<em> <strong>may<\/strong> increase the length \u2026 if there is evidence that the parties&#8217; economic marital partnership began during their cohabitation \u2026 prior to the marriage.<\/em><\/p>\n<p>If there was an <em>economic marital partnership, <\/em>an extension to the <em>length of the marriage<\/em>, is in the <strong>discretion<\/strong> of the judge (or arbitrator).<\/p>\n<p>Some evidence of an <em>economic marital partnership <\/em>includes the couple:<\/p>\n<ul>\n<li>holding themselves out as an intact family;<\/li>\n<li>wearing rings, they bought for each other;<\/li>\n<li>participating in activities together with their children;<\/li>\n<li>vacationing together;<\/li>\n<li>sharing finances;<\/li>\n<li>sharing the cost of housing.<\/li>\n<\/ul>\n<p>The <em>length<\/em> of the marriage ends when a spouse is served a notice of divorce.<\/p>\n<p><u>The second factor.<\/u> Once the length of the marriage is determined, the judge (or arbitrator) then sets the <em>duration<\/em> of alimony.<\/p>\n<p>Presumptive limits on the duration of alimony are based on the length of the marriage.<\/p>\n<p>Where the marriage is <strong>longer<\/strong> than 20 years, alimony may extend<em> for an indefinite length of time\u2026 . <\/em><\/p>\n<p>For 20 years or less there are four categories of duration:<\/p>\n<p><em>(1) If the length of the marriage is 5 years or less, \u2026 not longer than one-half the number of months of the marriage.<\/em><\/p>\n<p><em>(2) [<\/em>for]<em> 10 years or less, but more than 5 years\u2026 not longer than 60 per cent of the number of months of the marriage.<\/em><\/p>\n<p><em>(3 [<\/em>for<em>] 15 years or less, but more than 10 years, \u2026not longer than 70 per cent of the number of months of the marriage.<\/em><\/p>\n<p><em>(4) [<\/em>for] <em>20 years or less, but more than 15 years, \u2026not longer than 80 per cent of the number of months of the marriage.<\/em><\/p>\n<p><em>\u00a0<\/em>The above duration categories are presumptive and the judge (or arbitrator) may <strong><em>deviate<\/em><\/strong> from the presumption. (Rules for deviation are left for another article.)<\/p>\n<p>So, to determine the presumptive <em>duration<\/em> of alimony, first determine the length of the marriage and then fit the length into one of the 5 duration periods.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a9 2019 Anthony C.
