Of the Three Roads to Divorce,
Adversarial Divorce is the most misunderstood.
Often it is thought of as
“going for the jugular.” It does not have to be.
As your Adversarial Divorce lawyer my goal is to get you resolution on
issues surrounding property, money and, if you have them, your children.
To do this I first try to determine the important facts, for example the
value of your house.
Next, I work toward getting an agreement with
your spouse and your spouse’s attorney on all issues upon which we can
agree.
If there are areas upon which we cannot agree, your spouse’s lawyer
and I try to develop a way of getting complete agreement without a divorce trial.
Some of the ways include using mediation or arranging for a conference
with the judge assigned to your case.
Only after using all reasonable efforts at settlement do I recommend
trial.
If a trial is necessary, I use over twenty-five years of experience as a
trial lawyer, an arbitrator (a private judge), a master (appointed to take
the place of the judge for certain purposes), and a guardian (appointed to
investigate for the judge) to zealously present your case to the
trial judge. |
AS YOUR ATTORNEY: I will answer your questions.
I will
explain and recommend options to you.
I will work, if you have children, to make
sure their best interests are addressed.
Adversarial Divorce is best suited for resolving deep-seated
disagreement, for example, where there is no trust between spouses
or where there are complaints of parental incompetence or allegations that
the other party is hiding assets.
